    vtp.com $40k WIPO

vtp.com, one of the 15 x 3 letter .com's sold by Buydomains to Bigfoot at $40k each in June has been WIPO'd...

    Link to DNJournal sale report

    Link to vtp.com WIPO decision

Looks like Bigfoot parked it, listed it for sale for $148k and then thought a one man Panel would be ok.

Gee what a surprise, it's another domain transfer issued by James A. Carmody for a short acronym with many possible uses.

It resolves to a seeq.com page which is a buydomains site so I wonder if the purchase was charged-back or they just never got around to changing the dns

The udrp filing was only 2 days after Bigfoot appeared in the whois, so I imagine they had a word or two with Buydomains along those lines.

Presumably the udrp would have locked the name with domaindiscover, hence the seeq page.

But can't the dns still be changed even if a udrp is filed?

No, everything for the domain is locked pending the outcome of the UDRP or pending litigation which overrides the UDRP.

James A. Carmody either has no understanding of the UDRP, OR he is consciously and militiously deciding against domainers and for TM holders.

My consistent question has been: Is there no one in charge at ICANN or WIPO, who sees the blatant disregard of the UDRP by Carmody? Is there no one willling to FIRE him from his UDRP duties?

I know the ICA has much to do, especially with fighting for legislation on our behalf. However, could this not be a matter which the ICA could address with ICANN at some point? (Maybe someone from the ICA would be kind enough to post a reply to this question?)

Bad judges are regularly removed or voted out of office for a pattern of incompetence or bias.

It is without question that James A. Carmody is either one of the most incompetent UDRP panelists, OR he is blatantly and viciously biased against domainers. Either way, he is allowed by ICANN and WIPO to decide cases, and that should not stand.

Carmody is consistently doing so much damage to rightful domain owners. Is there no recourse against panelists like him, except to spend big bucks fighting their decisions in the courts?

Sadly, he's probably one of WIPO's best salesmen. His poor decisions encourage frivolous complaints and ensures concerned respondents always go for the 3-panel option.

Can't see why Bigfoot didn't go for 3 panelists here.

Wow. How could I forget: Always follow the money.

Foolish me. I was presuming that the integrity of the process was the prime consideration at WIPO and ICANN.

    Sad indeed.

    Thanks, JFSES.

Given the price paid for those names in the first place it is probably a fair bet they have no clue what they are doing.
