I only skimmed the 122 page complaint.
The class action approach could be a windfall for the lawyers.
And, I'm sure that will be the driving force.
For example, there is a lawyer in Baltimore that made $ 1 Billion
in fees from asbestos and tobacco class action cases.
He bought the Baltimore Orioles a number of years ago
using pocket change.
A friend of mine that is a criminal investigator for an unnamed gov't agency
said that RICO can easily be applied to many things.
Unfortunately, this could seriously injure the profitability of the domain industry.
Does anyone have a rusty razor blade they could send me?
I'll give you a TM domain in trade. Just kidding.
I believe I function with a white hat in this business.
But, this still scares me.
The biggest threat to me is being caught by that huge fishing net
that will be cast by the lawyers.
I keep thinking - have I a overlooked something in my portfolio?

Not too late --- given all the tasting companies that will taste every single dropping domain name, there's still an opportunity to add more defendants.

Dear parking company: It's 2007. You simply cannot be party to this. Ever. There's no "we couldn't be bothered to look at the list" defense what will hold up to judicial or jury scrutiny.
And the corporation can be pierced and individual fortunes can be put at risk. I've done it. The "I had my blinders on" defense is an imperfect one.

Could ICANN ultimately be named/enjoined for doing nothing about domain tasting and thus actually facilitating it? 
The RICO legislation is, from what I remember of seeing it used on satellite television piracy, very powerful stuff and in the right hands could be extremely dangerous for the whole domaining industry.

Yep and a few other dropcatchers will probably end up in this as well. The John Does leave considerable room for expansion. It could all get political very quickly. The worst case is that a significant part of the domaining business has come to a very abrupt halt but people don't even realise it yet. Of course that is the worst case.

Those damages look dangerously realistic. If it was multi-million Dollar damages it would be one thing but this makes it look more business-like to the non-lawyer readers.
