    TradeMark problem - HUGE company - am I asking for trouble?

    Hi All,

    I just found a domain that is not registered yet that I think could be RED HOT in more ways than one and wanted to get your opinion on if I should grab it.

    HOT new product coming out in a few months. Launch was delayed so much pent up anticipation. The company that makes it is owned by one of the biggest companies there is. So the name I have found is company name 4 char (aaaa) - product name 5 char (bbbbb).

    aaaabbbbb.com There are already lots of searches for this KW combo even though the product won't be availbe for several months. Once the product hits it should be even hotter.

    The huge parent company has the aaaa registered and the bbbbb registered but not the combo. I did a search and there are tons of aaaa combo names registered so I don't think they are protecting the company name. There are also lots of bbbbb names registered so it does not look like they have a problem with people using the product name.

    So if I grab it what's the worst that can happen? Ceast and desist? Force me to turn it over? Lawsuit?

    Maybe they don't care if I use it especially of I sell the product through an affiliate program or use adsence which esentially would help them sell more product? Or maybe they buy it for big bucks?

    Sorry NOOB question, but I just don't know.

    the worst think that can happen is they sue for damages, more likely possibilities are,

    -nothing happens
    -they send a c and d and nothing else
    -they take it to wipo
    -they threaten you then give you $500 or whatever for the name
    -they give you ~$500 without the threat
    GamesRoom.com, Possum.com, Arithmetic.com on greatdomains auction, low reserves, priced to sell!

    in the tools section here are links to the udrp and acpa - which are remedies available to tm holders. Its worth reading this if you have not done so already.
    When using google for counts - use double quotes for usage counts for multiword terms and set "match type" to "exact" for all search volume lookups. Click here for more info

    This company/product name combo would be similar to sonyviao.com or dellinspiron.com

    I just read on another forum that the company that owns this company has paid people huge sums for similar domains instead of suing.

    Thanks guys, I'll read those resources and then try to decide.

    First of all They wouldn't sue you...
    They will wipo'ed you...
    I seriously doubt that, no matter what company you are referring to, Companies like to set precedent and don't like to take the easy road and make deals with squatters, it will just make it more tempting for other people to continue that activity...
    and it will perpetuate the problem.
    (not to be "two faced" I have commited a few indiscretions in regards to this matter.)

    It can also depend on how generic/descriptive their name is - if its like "dell" or "sony" though it would be a cakewalk for them to win "name+word" type domains in dispute imo.
