We have added a new database of positive wording from UDRP cases in the tools section (button top right of screen).

In here you will find a multitude of panelist comment supporting domainer activities and other elements that will be of use if threatened.

Examples include:

Speculation within open domain namespaces is perfectly permissible within the boundaries set by the UDRP. A speculator might register perfectly innocent names with the address "Domain for Sale" to indicate that it is happy to contemplate sale of the name at some point in the future. Within the trade mark system of countries, and within the UDRP, it is permissible to sell one’s legitimate interest to a mark or name, if another party with a legitimate interest is prepared to offer a price that is acceptable.

and

Complainant counters this by arguing that the practice of registering defunct names to attract advertising hits is deceptive or inimical to the interests of Internet users. Neither the current UDRP nor current ICAAN registrar contracts preclude this type of domain name use.

Are .biz domains exceptions to these rules?

Is it ok to list .biz domains for sale?

the .biz contract prohibits registration purely for resale and its also the exact same UDRP so the exact same principles apply.

the only difference is where the dispute is heard under the STOP rules but I believe the window for those has passed.

interestingly, there is this bit of wording which I guess isn't actually enforced in the registration t & c's:

Registrant agrees not to resell the
Registered Name without the RA’s prior express written consent.
