    Arrow Kooks.com UDRP and lawsuit

    I noticed there was a UDRP filing for Kooks.com at WIPO:

    http://www.wipo.int/amc/en/domains/c...0200-0399.html (case D2008-0233)

    In response, it appears the owners of the domain are simply suing in court instead. See the lander at www.kooks.com that mentions their reverse hijacking suit. The links for the UDRP complaint, and the lawsuit complaint don't seem to work at this time, but it appears legitimate, given their experience in defending their use of "Spam Arrest."

    The complainant's website is apparently at:

    so you can see why they'd want to shorten their domain, as it's currently 18 letters long.

    I just hope they win at both venues now
    When using google for counts - use double quotes for usage counts for multiword terms and set "match type" to "exact" for all search volume lookups. Click here for more info

    Looking forward to the outcome on this one. Plaintiff (Global DNS) is claiming the Defendant (Kook's Custom Headers) obtained their USPTO trademark by fraud and consequently the trademark should be cancelled.

    Just because they were incorporated in 1996 doesn't mean rights weren't passed to the newly incorporated company that do date back to 1962.

    This isn't as clear cut as domainers are making out imo - those links in the complaint are the domain holders responsibility.

    You're right, Safesys. It looks like an overoptimized DomainSponsor landing page, given the screenshots in the UDRP complaint.

    However, I think it'll be difficult to show bad faith registration of the domain name (as opposed to "use"). I've seen a lot of internet kooks, but had never heard of "Kooks Custom Headers", and that's likely the case for a lot of people!

    Sort of off topic, but related: For domains that don't get any or much traffic, would it be safer not to have a parking page? It would seem to minimize the risk that safesys mentions without significantly reducing revenue.

    Yeah, or at least a park page where every link has been manually chosen - that way you're not open to some automated process putting potentially trademark infringing links on the page and you having to rely on a panelist absolving responsibility for them.
